This competence is not specifically enshrined in the Convention, however, it is recognized in article 39 of the rules of the Court. This article, by reviewing the Court’s case-law, investigates to what extent the Court invokes this jurisdiction and whether the interim measures entail enforcement mechanism. The findings of this article show that the Court is using interim measures in an exceptional manner to prevent the violation of articles 2 and 3 of the European Convention on Human Rights. Furthermore, due to the fact that the enforcement of interim measures is not expressly recognized in the Convention or the rules of the Court, the court by its judgments and with referring to article 34 of the European Convention, endeavors to establish an effective enforcement.}, keywords = {European Court of Human Rights,Interim Measures,European Convention of Human Rights and Fundamental Freedoms,Case-Law,Enforcement}, title_fa = {دستور موقت و ضمانت اجرای آن در رویه قضایی دیوان اروپایی حقوق بشر}, abstract_fa = {دیوان اروپایی حقوق بشر که رسالت اصلی آن رسیدگی به دادخواستهای فردی و دولتی در صورت نقض کنوانسیون اروپایی حقوق بشر و آزادیهای اساسی و پروتکلهای الحاقی آن توسط دولتهای عضو است، براساس صلاحدید خود یا درخواست خواهان، بواسطه صدور دستور موقت سعی مینماید تا از فعل دولتی که محتمل است خسارتی خطیر و جبرانناپذیری بر خواهان تحمیل کند، جلوگیری نماید. این صلاحیت صراحتاً در کنوانسیون موصوف پیشبینی نشده است اما در ماده 39 آییننامه داخلی  دیوان  مورد توجه قرار گرفته است. این مقاله با  بررسی رویه قضایی دیوان به دنبال پاسخ به این پرسش است که این رکن منطقهای در چه مواردی از صلاحیت مزبور استفاده میکند و چه ضمانت اجرایی در خصوص دستورات موقت پیشبینی شده است. یافتههای مقاله مؤید این مطلب است که دیوان بطور استثنایی و عمدتاً جهت جلوگیری از نقض مواد 2 و 3 کنوانسیون اروپایی حقوق بشر از گزینه دستور موقت استفاده مینماید و از آنجا که موضوع ضمانت اجرای این نوع دستورات در کنوانسیون و آییننامه دیوان مورد توجه قرار نگرفته است، این رکن قضایی سعی کرده است از طریق آرای خود و با استناد به ماده 34 کنوانسیون به تدریج زمینه ضمانت اجرای موثر دستورات صادره را فراهم نماید.}, keywords_fa = {دیوان اروپایی حقوق بشر,دستور موقت,کنوانسیون اروپایی حقوق بشر و آزادی‌های اساسی,رویه قضایی,ضمانت اجرا}, url = {https://qjpl.atu.ac.ir/article_11020.html}, eprint = {https://qjpl.atu.ac.ir/article_11020_1bbaec71674f388514d14c6d75dc422a.pdf} }
