The purpose of the former is personal economical interests, while the latteris collective human interests. However, the atmosphere in which both of them areapplied, is the same. These two branches of international law are definable out oftraditional international law which is State-centric; since the internationalinvestment law concerns the relationships of State actors with non-State actors whoare away from the principle of equality of sovereigns, and internationalenvironmental law concerns the common heritage of mankind at all which is awayfrom the principle of consent of States. The present essay with special reference tothe last case at the ICJ called “The Case Concerning Pulp Mills on the River,Argentina vs Uruguay” and other common sources of these two laws, tries toexplore and analyze existent conflicts in applying two laws. At the end, authorsuggests some working methods for reconciling of international investment law andinternational environment law. A balance between these two branches ofinternational law not only would prevent detriments to national and foreigninvestors- that existence of international economic depends on them- but also wouldprevent harms to environment which is necessary milieu for investment.}, keywords = {International Investment Law,International Environment Law,International Investment Arbitrary,Most Favored Nations Clause,Emission Trade,The Case Concerning Pulp Mills on the River (Argentina vs Uruguay)}, title_fa = {جایگاه تعهدات زیست محیطی در حقوق بین الملل سرمایه گذاری}, abstract_fa = {روابط حقوق بین الملل سرمایه گذاری و حقوق بین الملل محیط زیست، یک رابطه تعارض دراهداف اما تلاقی در عمل است. هدف یکی مفنعت اقتصادی شخصی و هدف دیگری منافع بشریجمعی است، اما قلمرو اجرای هر دو حقوق مربوط به یک محیط است. ای ن دو شاخ ه از حقو قبین الملل، خارج از نظام کلاسیکحقوق بین الملل که نظامی دولت محور استقابل تعریفاس تچرا که حقوق بین الملل سرمای ه گذار ی ب ه روابط اقتصاد ی میا ن بازیگرا ن دولت ی و با زیگرانغیردولتی می پردازد که خارج از اصل برابر ی حاکمی ت ه ا عم ل م ی کن د و دیگر ی ب ه میرا ثمشترکبشریتو جامعه بین المللی در کل مربوط می شود که خار ج از اص ل رضای تدول ت ه اعمل می کند. در این مقاله تلاش شد با توجه خاص به آخرین قضیه مرتبط در دیوان بی نالمللیدادگستری یعنی قضیۀ کارخانه کاغذسازی آرژانتین علیه اروگوئه و همچنین بررسی سایر منابعمشترک این دو شاخه از حقوق بین الملل به تبیین تعارضات موجود در اجرای حقوق بی نالمللسرمایه گذاری و حقوق بین الملل محیط زیست اشاره شود و در نهایت راهکارهایی برای آشتی میاناین دو حقوق ارائه شود. ایجاد توازن میان این دو شاخۀ حقوق بین الملل موجب خواهد شد ت ا ن هسرمایه گذاران ملی و خارجی که چرخ های اقتصادی بین المللی هستند بی سببمتضرر شون د و ن همحیط زیستکه محیط لازم برای زیستو سرمایه گذاری است، بی جهتصدمه ببیند}, keywords_fa = {حقوق بین الملل سرمایه گذاری,حقوق بین الملل محیط زیست,داوری بین المللی سرمایه گذاری,شرط رفتار ملی,تجارت آلودگی,قضیۀ کارخانه کاغذسازی(آرژانتین علیه اروگوئه)}, url = {https://qjpl.atu.ac.ir/article_259.html}, eprint = {https://qjpl.atu.ac.ir/article_259_797b7fb6f3da5c0e9ea48bbd913541c5.pdf} }
