دفاع مشروع بازدارنده در قرن بیست ویکم
در حالی که اکثریّت قاطع دولتها اقدام به دفاع مشروع بازدارنده نکردهاند و معتقدنـد کـه اقـدام بـدان، سابقهای خطرناک را ایجاد خواهد نمود و شگفت آنکه برخی نویسندگان از آن حمایت میکنند. پس از رویداد یازدهم سپتامبر، نداهای رساتری در حمایت از مشروعیّت ایدهی مزبور به گوش رسید. آنچه موضوع را وخیمتر نمود، اعلام دفاع مشروع پیشگیرانه در استراتژی امنیّت ملّـی ایـالات متّحـدة آمریکـا بود که از مفهوم سنّتی دفاع مشروع بازدارنده بسیار فراتر میرفت. بحثهای نظری دیرینه با شدّت بیشتری از سر گرفته شدند. مقالهٔ حاضر تلاشی است برای ارزیابی مجدّد بحثها و سنجش قانونی بودن دفـاع مشـروع بازدارنده. بدین منظور، تفسیری عینی از مادّة 51منشور ملل متّحد در پرتو قواعد تفسیر معاهدات ارائـه خواهـد شد و حقوق بینالملل عُرفـی احـراز خواهـد گردیـد. بررسـی مجـدّدی از ضـوابط رویـداد کـارولین صـورت خواهد گرفت و تأیید خواهد شد که دفاع مشروع بازدارنده به دلیل فقدان رویـهٔ گسـترده و یکنواخـت و عـدم اعتقاد حقوقی دولتها، پیشاز رویداد یازدهم سپتامبر، به عنوان حقـوق بـینالملـل عُرفـی احـراز نشـده بـود و بدین نتیجه دست یافته است که پس از رویداد یازدهم سپتامبر، گرچه رویهی دولتهـا گـرایش بـه تسـاهل در قبال توسل به زور علیه تهدیدات قریبالوقوع تروریسـتهـا دارد، بـا ایـن حـال مـادهی 51منشـور ملـل متّحـد کماکان مقرّرهای مناسب جهت تنسیق توسل به زور بین دولتها به شمار میآید

مقرّرات حاکم بر سرمایهگذاری خارجی در پروژههای بالادستی صنعت نفت ایران بهویژه به روش تسهیلات بیع متقابل
با توجه به نقش حیاتی صنعت نفت برای توسعهٔ موقعیت اقتصادی ایران، لزوم جذب سرم آیههای
خارجی و تشویق و حمایت آنها در پروژههای بالادستی این صنعت بهویژه از طریق انعقاد قراردادهای
پیمانکاری خدماتی (بیع متقابل) با سرمایهگذاران و شرکتهای نفتی بینالمللی امری انکارناپذیر به نظر
میرسد.
بدین منظور، تحقیق حاضر سعی در برشمردن قوانین و مقرّرت حاکم بر سرمایهگذاری خار جی در
پروژههای بالادستی بهویژه به روش تسهیلات بیع متقابل دارد تا با بررسی، توصیف تحلیل آن موقعیت
حقوقی ایران را برای تشویق و حمایت از سرمایهگذاریهای خارجی در بخش بالادستی صنعت نفت
تشخّص سازد و نظام حقوقی حاکم بر این پروژهها را شفّاف سازی کند.
تحولات اخیر در قانونگذاری در حوزهٔ بالادستی نفت و گ از ب ه ویژه مواد125 تا 129 قانون به رنام سهٔ
پنج سال سهٔ پنجم توسعهٔ اقتصادی، اجتماعی و فرهنگی و همچنین قانون اصلاح قانون نفت مصوب تیرماه
1390 حکایت از آن دارد که قانونگذار ضمن حفظ دو اصل مهم حاکمیت و مالکیت دولت بر ذخایر و نفت
گاز تولیدی از میدانها، نهتنها امکان استفاده از روشهای مختلف بینالمللی بالادستی را پیشبینی نموده است،
بلکه انعقاد و واگذاری قرارداد را در ادوار مختلف اکتشاف، توسعه و تولید و بهرهبرداری نیز اجازه داده است.

رواداری (تلورانس) در نظام بین المللی حقوق بشر
» رواداری از مهم ترین و در عین حال پیچید هترین مفاهیم در حقوق بشر بی نالملل است رواداری را یکی از ارزش های بنیادین و اساسی در کلیه ی روابط بی نالمللی « هزاره ی سران ملل متّحد قرن بیست و یک قلمداد کرده است ظهور و بروز مظاهر جدید نارواداری در سالیان اخیر نیا ز به رواداری را به ضرورتی غیر قابل اجتناب مبد ل کرده اس ت. صر فنظر از معانی متفاوت رواداری حوزههای مختلف فلسفی، مذهبی و سیاسی، رواداری را در مفهوم عام و به طور کلّی، می توان فرمول متم دنانه ی همزیستی مسالمت آمیز افراد بشر را که در دیدگاه ها، عقاید، اعتقاد ات و سایر ویژگ یهای هستند، در کلیه ی مراودات و مناسبات اجتماعی دانست. « متفاوت » خود این مفهوم به گونه ی غیر قابل انکاری با تکثّر اندیشه و رفتارها همراه بوده و تکثّرگرایی به ویژه تکثّرگرایی فرهنگی پایه و اساس مفهوم رواداری را تشکیل می ده د. به لحاظ تاریخی، مفهوم مدرن رواداری در آغاز عصر کنونی توسعه و ترقّی یافت، ا ما سوابق اندک و در عین حال مهمی از آن را در دوران باستان نیز می توان یافت، به گونهای که در موارد متع ددی نویسندگان جدید از آن الهام گرفتهاند. ا ما آنچه مسلّم است اینکه رواداری در ابتدا مفهومی کاملاً اخلاقی داشت و محدود به پذیرش ح ق انتخاب مذهب از سوی فرد و عمل به آن بوده است، ا ما بعدها پس از قرن 18 مفهوم آن بسط یافت به معنی احترام به هرگونه اعتقاد، خواه مذهبی یا سیاسی، تغییر کرد. مفهوم رواداری از یک سو مبتنی بر شناخت حقوق دیگران و احترام به شخص یت و هو یت آنان در عین داشتن تفاوت در اعتقادات، فرهنگ، زبان و... است و زمینهساز گف توگو و تبادل اندیش هها در فضای ی آکنده از احترام متقابل می باشد. ارزش های اجتماعی و سیاسی نوین که هنجارهای بین المللی در زمین ه ی حقوق بشر از آ نها نشأت گرفتهاند، در ابتدا به واس طه ی نیاز به رواداری به عنوان اساس یترین شرط برای حفظ نظم اجتماعی تحت قاعده درآمدهاند. از سوی دیگ ر، مفهوم رواداری، تبلیغ و گسترش آن، به واس طه ی آموزش، عاملی اساسی در برقراری صلح میان افراد، گروه ها، ملّت ها و دولت ها می باشد. نقش کلیدی آموزش رواداری به منظور دستیابی به صلح به وضوح در اعلامی ه ی جهانی حقوق بشر، اعلامیه ی اصول رواداری و برنامه و طرح اقدام فرهنگ صلح مورد اشاره واقع شده است.

مسئولیت بینالمللی دولتها در قبال اعمال شرکتهای خصوصی از منظر رویهی قضایی و داوری بینالمللی
در حقوق داخلی در مواردی استثنائی حجاب شخصیت حقوقی شرکت کنار نهاده می شود و در راستای استیفای حقوق اشخاص ثالث، اعضای مسئول اعمال شرکت قلمداد میگردند. در حقوق بینالملل نیز با تحقق مجموعهای از شرایط، پوشش شرکتی کنار گذاشته میشود و زمینه ی طرح مسئولیت یکی از کاربردهای خرق حجاب شرکتی در مورد مسئولیت بینالمللی دولت در قبال اعمال شرکتهای خصوصی مجال بروز پیدا میکند. به این منظور یا باید اثبات گردد که شرکت خصوصی مبادرت به اعمال اقتدارات دولتی میکرده یا باید ثابت گردد که شرکت تحت کنترل و به دستور دولت ذیربط عمل نموده است. افزون بر این موارد، تعهد دولتها به تضمین قواعد حقوق بشری موجب آن میشود که حتی علیرغم عدم احراز شرایط فوق، دولتها در قبال اعمال شرکتهای خصوصی مسئول شناخته شوند.

بررسی تطبیقی اجرای اصل احتیاط زیست محیطی در پرتو آرا و تصمیمات مراجع بین المللی
اصل احتیاط یکی از مهمترین اصول حقوق بینالملل محیط زیسـت محسـوب مـیشـود. بـر اسـاس ایـن اصل، برای حفاظت از محیط زیست، دولتها باید متناسب با امکانات خـود تـدابیر احتیـاطی وسـیعی را اعمال نمایند. در صورت خطر ورود صدمات شدید یا غیر قابل جبران، عدم وجود دلایل قطعـی علمـی نباید بهانهای برای تأخیر در اتّخاذ تدابیر مـؤثّر بـرای پیشـگیری از ورود صـدمه بـه محـیط زیسـت شـود. علیرغم شناسایی این اصل در اسناد مختلف زیست محیطی، در مرحلـهی اجـرا ایـن اصـل بـه صـورت واحدی در مراجع بینالمللی رعایت نمیشود. این مقاله با روش توصیفی و تحلیلـی و کنکـاش در آرا و تصمیمهای برخی از مراجع بین المللی در صدد تجزیـه و تحلیـل رویکـرد ایـن مراجـع نسـبت بـه اصـل احتیاط است تا بدین وسیله اقبال و عدم اقبال اصل مزبور را در حقوق بین الملل نشان دهد.

جستاری در باب اعمال صلاحیت کیفری بر جرایم نیروهای پاسدار صلح
در پی افزایش ارتکاب جرایم مختلف به ویژه نسبت به افراد غیرنظامی توسط برخی از نیروهای پاسدار
صلح و ضرورت اجرای عدالت کیفری، موضوع اعمال صلاحیت بر این جرایم مطرح شده است. به
طور کلّی، موافقت نامه ای دول ت ها با سازمان ملل در خصوص اعزام نیرو، صلاح یت انحصا ری
رسیدگی را به دولت فرستنده نیرو میدهند؛ هم چنانکه در صورت وقوع مخاص مه ی مسل حّانه و نقض
حقوق بشردوستانه توسط نیروهای پاسدار صلح، صلاحیت تعقیب متّهم از آنِ دولت فرستنده نیرو است.
این مقاله، علاوه بر بحث در باره تکلیف دادگاههای ملّی در اعمال صلاحیت، به بررسی امکان پیگرد
نیروهای پاسدار صلح در محدوده صلاح یت دیوان بین المللی کیفری میپردازد.
