سیر تحول نحوه مداخله دولت در اقتصاد از منظر حقوق عمومی، از دولت رفاه تا دولت فراتنظیمی

چکیده

چگونگی مداخله دولت در اقتصاد همواره از مباحث چالش برانگیز در مکاتب مختلف
اقتصادی و حقوقی بوده است. دولت رفاه با دخالت مستقیم در اقتصاد و در دست گرفتن بسیاری
از امور جامعه، موجب پدید آمدن بحران اقتصادی در کشورهای غربی شد و در راستای حل این
معضل، دولتهای تنظیمی روی کار آمدند که برای رونق اقتصادی و سرعت بخشی به گردش
چرخۀ اقتصادی جامعه، امور را به بخش خصوصی واگذار نمودند و خود با مقررات گذاری متعدد
به تنظیم رفتارهای اشخاص در اقتصاد پرداختند؛ اما پیچیدگی امور اقتصادی محلها و بخش ها ی
صنعتی مختلف، موجب شد که دولت تنظیمی برای تنظیم امور اقتصادی جامعه، بعضاً مقررات
گذاری را به نهادهای خودفرمان واگذار کند که این امر مقدمه ای برای طرح نظری ۀ دولت
فراتنظیمی گشت. در این مقاله به تحولات فکری در مورد حدود اختیارات دولت نسبت به امور
اقتصادی جامعه از منظر حقوق عمومی، بهطور تطبیقی از دورة دولت رفاه تا فراتنظیمی میپردازیم

چکیده [English]

State intervention in the economy has always been a challengingissues in schools
of economy and Law.Welfare states, bydirect intervention in economy, took over most
of the affairs and caused economic crisisin the West. To curb the downfall, regulatory
states emerged, which sought to flourish and facilitate economic activities by adopting
privatization policies and pursued the goal through extensive legislations in myriad
areas with the hope to best regulate individual behaviors in the domain of economy.
States also happened to grant and empower self-regulatory /autonomous bodies with
legislative authorities which was the outset for the emerge of post-regulatory states.
This article reviews the Intellectual developmentsconcerningthe extent to which States
make intervention in economic affairs from the perspective of public law, through a
comparative study ranging from welfare to post-regulatory governments
