مسئولیت دولت در قبال نقض حقوق بین‌الملل بشر توسط شرکت‌های فراملی

چکیده

امروزه شرکت‏های فراملی را می‌توان یکی از کنشگران مهم عرصه بین‏المللی تلقی کرد. این ویژگی مهم حقوق بین‌الملل عمومی معاصر است. رشد شرکت‏‏های مزبور و توسعه فعالیت آن‏ها باعث شده است تا ضرورت تسری قواعد حقوق بین‌الملل به این موجودیت‏های نوظهور در عرصه بین‏المللی مورد بررسی قرار گیرد. هم‌چنین در این خصوص و به‏ویژه در پرتو قواعد راجع به مسئولیت بین‌المللی دولت بررسی این مسأله حایز اهمیت است که اصولاً آیا دولت‌ها در قبال اقدامات شرکت‏های فراملی متبوع خود در ورای مرزهای ملی خود دارای مسئولیت می‏باشند یا خیر؟ هم‌چنین آیا دولت‌های میزبان این شرکت‏ها در قبال اقدامات متخلفانه آن‎ها مسئولیت دارند یا خیر؟ این نوشتار به بررسی این پرسش‏ها پرداخته است.

Today, transnational corporations are regarded as prominent actors in international arena. This is deemed by many as a significant feature attributable to modern international law. Rapid growth of these corporations and expansion of their activities resulted in growing concern as to studying the necessity of extending the rules of international law to encompass such novel entities. Furthermore, there are concerns as to whether states to which transnational corporations are nationals may bear responsibility for their activities beyond national borders. This paper also studies whether the host states of these corporations may be held responsible for their wrongful actions.
