The main goal of this article is to clarify the allocation of these five seats and its position within the scope of the principle of equality, which was done by describing-analyzing method and collecting library-documentary information. The research suggested that five members are guaranteed at a minimum and there are no limitations. It is changed in statute and parliament election also has established significant discrimination through the election system of the religious minorities that appear during the process of enrolment, qualifications, the structure of supervisions, provincial and central, voting and dividing election centers.Finally, positive discrimination has changed into a negative one. The solution is to correct the acts and regulations. So we suggest amending the laws in secondary fields and voting centers, and also the participation of minorities in control boards, and increasing minorities members in parliament.}, keywords = {Article 64 of the Constitution of the Islamic Republic of Iran,Iran Parliamentary Election,religious minorities,equality,Positive Discrimination}, title_fa = {نظام حقوقی انتخابات نمایندگان اقلیت‌های دینی شناخته‌شده در مجلس شورای اسلامی ایران در پرتو اصل برابری}, abstract_fa = {وفق نظر غالب در تفسیر اصل 64 قانون اساسی جمهوری اسلامی ایران؛ پنج کرسی اقلیت‌های دینی شامل زرتشتیان، کلیمیان و مسیحیان (ارامنه شمال و جنوب، آشوریان و کلدانیان) در مجلس شورای اسلامی غیرقابل افزایش است. مساله اصلی مقاله، روشن نمودن موضوع اختصاص این 5 کرسی در مجلس و جایگاه آن در محدوده اصل برابری است که با روش‏ توصیفی _ تحلیلی و شیوه گردآوری اطلاعاتِ کتابخانه‌ای _ اسنادی، انجام شده است. یافته‌های پژوهش حکایت از این دارد که پنج نفر، حداقلی تضمین شده است و سقفی ندارد. امری که در حقوق موضوعه و رویه عملی انتخابات مجلس، تغییر یافته و تبعیضی را در نظام انتخاباتی این اقلیت‌های دینی پدید آورده که در مراحل «ثبت نام، احراز شرایط، ترکیب هیئت‌های نظارت حوزه انتخابیه، استانی و مرکزی، رای‌دهی و تقسیم‌بندی حوزه‌ها» نمود یافته و در پایان، تبعیضی مثبت در قانون اساسی به تبعیضی منفی مبدل گشته است. راه حل اما اصلاح قوانین عادی و مقررات بر این اساس است. لذا پیشنهاد مشخص در این زمینه، اصلاح قانون در زمینه حوزه‌های فرعی و شعب اخذ رای؛ استفاده از اقلیت‌ها در هیئت‌های نظارت و تصریح به امکان افزایش نمایندگان اقلیت‌‌ها در مجلس می‌باشد.}, keywords_fa = {اصل 64 قانون اساسی,انتخابات مجلس شورای اسلامی,اقلیت‌های دینی,برابری,تبعیض مثبت}, url = {https://qjpl.atu.ac.ir/article_14324.html}, eprint = {https://qjpl.atu.ac.ir/article_14324_83b32a8d4238146ec18fd4d4bf9e9a81.pdf} }
