Sometimes in spite of taking all preventive measures, some authorized and legitimate activities of States that are generally dangerous can cause irreparable damages to other subjects of international law and especially to the environment. For as much as these activities are not prohibited, the traditional systems of civil responsibility are not effective when dealing with the compensation of environmental damages. Therefore, the development and codification of particular system of compensation for environmental damages is inevitable. The result of international community's effort in this context is the approval of draft of International Law Commission titled Draft Principles on the Allocation of Loss in the Case of Transboundary Harm Arising out of Hazardous Activities, with Commentaries 2006” declaring that the State is responsible and obliged to prevent and the operator of hazardous activity is obliged for compensation of the damages under circumstances to commit such acts}, keywords = {Environment,Environmental Damages,Compensation,International Law Commission,Draft Principles of 2006}, title_fa = {جبران خسارات زیست‌محیطی بر اساس طرح 2006 کمیسیون حقوق بین‌الملل مبنی بر اصول تخصیص زیان در موارد آسیب فرامرزی ناشی از فعالیت‌های خطرناک}, abstract_fa = {جبران خسارات زیست محیطی فرامرزی، بویژه در خصوص آسیب‌های ناشی از فعالیت‌های خطرناک، یکی از مسائل  غامض نظام مسئولیت در حقوق بین‌الملل محیط زیست محسوب می‌شود.یکی از مشکلات این است که گاهی باوجود اتخاذ تمامی اقدامات پیشگیرانه، برخی فعالیت‌های مشروع و مجاز دولت‌ها که عموما خطرناک نیز هستند، خسارات جبران‌ناپذیری به سایر اشخاص حقوق بین‌الملل و به خصوص به محیط زیست وارد می‌کنند. ازآنجاییکه این فعالیت‌ها ممنوع نیستند، نظام سنتی مسئولیت مدنی در پاسخگویی به این خسارات کارآمد نمی‌باشد؛ از اینرو توسعه و تدوین نظامِ خاصِ جبران خسارات زیست محیطی اجتناب‌ناپذیر می‌باشد. حاصل تلاش جامعه بین‌المللی در این زمینه تصویب طرح پیش‌نویس 2006 کمیسیون حقوق بین‌الملل با موضوع" اصول تخصیص زیان در موارد آسیب فرامرزی ناشی از فعالیتهای خطرناک" است که دولت را تحت شرایطی به­دلیل ورود خسارت جدی به محیط زیست مسئول و متصدی فعالیت خطرناک را موظف به جبران خسارت، حتی در صورت فقدان عنصر نقض تعهد می‌داند. در این پژوهش تلاش بر این است که پس از تحلیل خسارات زیست محیطی در پرتو نظریه اعمال منع نشده و تببین ویژگی‌ها و تمایزهای این نوع خسارات از سایر خسارات در حقوق بین‌الملل و با ملاحظه پیش‌نویس 2006 کمیسیون حقوق بین‌الملل، از روش توصیفی _ تحلیلی برای ارزیابی ابعاد مختلف موضوع استفاده شود.}, keywords_fa = {Environment,Environmental Damages,Compensation,International Law Commission,Draft Principles of 2006}, url = {https://qjpl.atu.ac.ir/article_7786.html}, eprint = {https://qjpl.atu.ac.ir/article_7786_d376e7737927e36b6b7023d4a7cf9ed3.pdf} }
