However, it is undeniable that in some cases, the General Board of Administrative Justice Court (“GBAJC”) has evaded or neglected to abide by this rule. Failure of the GBAJC to comply with this rule could be occurred in invocation of any of the legal evidences. In this paper, by studying the types of violation of this rule by the GBAJC in invocation of "the Constitution", it was seen that this violation resulted in issuing doubtful or even wrongful decisions. Hence, given that the GBAJC is the unique referee for complaint of governmental regulations, and its judgments are not supervised by any other institutions, it can be rightly expected that it shall try harder for precise observance of this rule; in particular, given that the consequences of its wrongful judgments in revocation or not revocation of governmental regulations not only is confined to the plaintiff itself but can affect a large group of people.   Keywords: Reasonableness of Judicial Decisions, the General Board of Administrative Justice Court, Judgment, the Constitution, the Guardian Council.  }, keywords = {Reasonableness and Legality of Judicial Decisions,the General Board of Administrative Justice Court,Judgment,the Constitution,the Guardian Council}, title_fa = {مستدل و مستند بودن آرای هیأت عمومی دیوان عدالت اداری؛ ایراد در استناد به قانون اساسی}, abstract_fa = {«مستدل و مستند بودن آرای قضایی» یکی از پذیرفته‌شده‌ترین اصول حقوقی حاکم بر هر مرجع قضایی و شبه‌قضایی است و دیوان عدالت اداری نیز به عنوان یک مرجع قضایی، مشمول این قاعده است. با وجود این، نمی‌توان انکار کرد که هیأت عمومی دیوان در بعضی موارد از رعایت این قاعده غفلت کرده و یا از آن طفره رفته است.عدم رعایت قاعده مستدل و مستند بودن آرای هیأت عمومی دیوان می‌تواند در استناد به هر یک از دلایل اثبات حکم روی دهد. در این نوشتار با بررسی انواع نقض قاعده مستدل و مستند بودن آرای قضایی در استناد هیأت عمومی دیوان به «قانون اساسی»، ملاحظه می‌شود که این نقض موجب صدور آرای تردیدآمیز و حتی اشتباه شده است. از این‌رو، با در نظر گرفتن این‌که هیأت عمومی دیوان، مرجع منحصر به فرد شکایت از مصوبه‌های دولتی است و تصمیماتش تحت نظارت هیچ مرجع دیگر نیست، به‌حق می‌توان انتظار داشت برای رعایت دقیق این قاعده، بیشتر تلاش کند؛ بویژه آن‌که پیامدهای رأی اشتباه این مرجع در ابطال یا عدم ابطال یک مصوبه دولتی محدود به فرد شاکی نیست و می‌تواند گروهی زیاد از مردم را تحت تأثیر قرار دهد.}, keywords_fa = {مستدل و مستند بودن آرای قضایی,هیأت عمومی دیوان عدالت اداری,دادنامه,قانون اساسی,شورای نگهبان}, url = {https://qjpl.atu.ac.ir/article_9968.html}, eprint = {https://qjpl.atu.ac.ir/article_9968_a48c902e81816fefad0a05e13ffa391c.pdf} }
