بررسی کنترل اقتدار بوروکراتیک در بستر مناسبات بوروکراسی، سیاست و کارآمدی
عملکرد موفق نظامهای سیاسی، وابسته به وجود یک اداره کارآمد است. در ارتباط با اداره
عمومی و سازماندهی آن تا دهه 1980 بوروکراسی نظامی بیبدیل برای تأمین کارآمدی در ارتباط
با تمامی کارکردهای دولت انگاشته میشد. باوجود این، بوروکراسی بهویژه در دوران دولت رفاه،
به دنبال گسترش دستگاه اداری دولت، با شکلدادن به اقتداری مستقل از جامعه و نهادهای
دموکراتیک، در تعارض با ارزشهای دموکراتیک قرار گرفته و همین امر موجب تلاشهای
نظری و عملی در بستر نظامهای دموکراتیک برای اصلاحات در جهت دموکراتیزهکردن آن شده
است. نظریهها و روشهای پیشنهادشده برای اصلاحات، متنوع بوده است. در این ارتباط میتوان به
نمایندگی در بوروکراسی، انتصابات سیاسی و بهکارگیری اصول وآیینهای اداری اشاره کرد.
علاوه بر این، روشها و فنون ارائهشده در چارچوب مدیریت عمومی نوین در سالهای بعد از
1980 در جهت کارایی و بازدهی، اثربخشی و صرفهجویی در استفاده از منابع نیز موجب تضعیف
اقتدار بروکراتیک بودهاند. روشهایی که در کنار کاستن از حجم بوروکراسی، پاسخگویی آن را
نیز تسهیل کردهاند.

تعیین حوزه صالح مالیاتی در معاهدات مالیاتی دوجانبه و مقابله با « مقر دائمی » سوءاستفاده از مفهو
انعقاد معاهدات دوجانبۀ مالیاتی در جهان بهعنوان ابزاری برای اجتناب از اخذ مالیات مضاعف
که مانعی در مسیر گسترش تجارت بینالملل تلقی میشود، رواج چشمگیری دارد. در متن این
به معنای پایگاهی ثابت برای انجام کسبوکارِ موردنظر « مقر دائمی » معاهدات، مفهومی با عنوان
شرکتهای مقیم دو کشور متعاهد، گنجانده شده است تا مشمولیت مالیاتی فعالان اقتصادی این دو
کشور تبیین شود. تعیین مسألۀ اقامت، جهت تشخیص وضعیت مالیاتی مؤدیان از اهمیت خاصی
به معنی مقیمبودن و ،« مقر دائمی » برخوردار است و در معاهدات دوجانبۀ مالیاتی نیز احراز وجود
مشمولیت مالیاتی مؤدی مقیم خارج از کشور نسبت به سود قابل تخصیص به این واحد است. اما
دیده میشود که شرکتهای فراملی با اتخاذ تدابیری متقلبانه تلاش دارند بهناحق، از مفاد معاهدات
دوجانبۀ مالیاتی برای کاستن از مسئولیت مالیاتی خود، سوءاستفاده نمایند. سازمان توسعه و
همکاری اقتصادی برای مواجهه با تدابیر شرکتهای فراملی بهمنظور گریز و اجتناب مالیاتی،
رهنمودها و اصلاحیههایی منتشر کرده است که کاربست آنها در نظام حقوق مالیاتی ایران نیز در

برچیدن تأسیسات نفت و گاز دریایی از منظر حقوق بین الملل
برچیدن تأسیسات نفت و گاز دریایی یکی از مسائل پیچیده صنعت نفت و گاز عصر حاضر به شمار میرود که دربرگیرنده مسائل حقوقی، اقتصادی، سیاسی و زیستمحیطی گستردهای است. اگرچه این مسائل همواره در صنعت نفت و گاز جهان دارای اهمیت بودهاند، بااینحال، از اواسط دهه 1980 که تولید از میدانهای نفت و گاز دریایی رو به افول گذاشت، ابعاد مختلف آن به چالشی جدی برای دولتهای میزبان و شرکتهای نفتی تبدیل شده است. این نوشتار ضمن اینکه درصدد شناسایی چالشهای پیش روی این صنعت در رابطه با برچیدن تأسیسات نفت و گاز دریایی است، به دنبال پاسخ به این مسئله است که چه مقرراتی در سطح بینالمللی بر مدیریت حقوقی جمعآوری این تأسیسات حاکم است و دیگر اینکه آیا قوانین و مقررات بینالمللی و منطقهای موجود از کارایی مناسبی برخوردار است. مقاله حاضر بر این نتایج استوار است که مقررات بینالمللی موجود از هماهنگی لازم و کارایی مناسبی برخوردار نبوده و علاوه بر این، در حال حاضر، یکسانسازی و به عبارتی تشکیل حقوق عرفی بینالمللی در خصوص برچیدن تأسیسات نفت و گاز دریایی، به دلیل اینکه مبانی کافی برای ایجاد چنین قاعدهای وجود ندارد، میسر نیست.

تأملی بر احقاق حقوق قربانیان سلاحهای شیمیایی در پرتو صلاحیت مدنی جهانی: با تأکید بر قربانیان ایرانی کاربرد سلاحهای شیمیایی جنگ عراق علیه ایران
نقض مقررات حقوق بینالمللِ مربوط به حمایت از فرد انسانی، چه در زمان صلح و چه در زمان جنگ، میتواند منجر به جنایت بینالمللی شود. رسیدگی به این جنایات، ازجمله میتواند از رهگذر اعمال صلاحیت جهانی کیفری عینیت یابد. در این نوشتار، این پرسش قابل طرح است که آیا حقوق بینالملل به کشورها اجازه میدهد تا صلاحیت مدنی فراسرزمینی خود را نیز اجرا کنند؟ در این پژوهش، نگارنده به بررسی این مسئله پرداخته است که از منظر حقوق بینالملل، آیا امکان دریافت غرامت برای ایرانیان قربانی کاربرد سلاحهای شیمیایی جنگ تحمیلی عراق علیه ایران در وجود دارد یا خیر؟ در پاسخ به این پرسش، نگارنده به بررسی « صلاحیت مدنی جهانی » پرتو مفهوم صلاحیت مدنی جهانی، مبانی حقوقی آن، رویه کشورها و قابلیت اعمال آن در خصوص مصدومین شیمیایی ایرانی پرداخته است.

تأثیر رویه و رفتار سرمایه گذار در تعدیل خسارات ناشی از نقض استانداردهای حمایتی معاهدات سرمایه گذاری
تعیین میزان خسارت وارده به سرمایهگذار، یکی از مهمترین جنبههای رسیدگیهای داوری
سرمایهگذاری است. در ارزیابی خسارت در این دعاوی، گاهی با توجه به وقایع و اوضاعواحوال
دعوا، لزوم تعدیل و کاهش خسارت پیش میآید. این امر میتواند با توجه به تأثیر سایر قواعد
حقوق بینالملل در سنجش مسئولیت و ارزیابی خسارت در این دعاوی توجیه شود. با توجه به
رویه داوری سرمایهگذاری، رفتار و رویه سرمایهگذار میتواند در جریان فعالیت او در کشور
میزبان و نیز پس از نقض تعهد توسط دولت میزبان، در تحدید و تعدیل خسارت از سوی دیوان
داوری لحاظ شود. اصولاً تعهدات مندرج در معاهده سرمایهگذاری برای حمایت از سرمایهگذاران
است، اما بهطور خاص، ممکن است رویه سرمایهگذار در مواردی برای کاهش خسارت ناشی از
نقض تعهد رفتار عادلانه و منصفانه لحاظ شود. مشارکت در زیان و عدم ایفای تعهد جلوگیری از
گسترش خسارت نیز میتواند تحت عنوان رفتارهای مربوط به پس از نقض تعهد توسط دولت که
در کاهش خسارت مؤثر است مطالعه شود.
توجه به عوامل تعدیلکنندة خسارت میتواند موجب توسعه قواعد خسارت در داوریهای
سرمایهگذاری و ارتقای مشروعیت این نظام شود

استفاده عراق از سلاحهای شیمیایی علیه ایران در جنگ تحمیلی: مسئولیت اشتقاقی ایالات متحده امریکا
در دنیای کنونی بینالمللی، ارتکاب اعمال متخلفانهای که بیشاز یکبازیگر در آن نقش دارند
افزایشیافته است. ازاینرو، طرح 2001 کمیسیون حقوق بینالملل در خصوص مسئولیت بینالمللی
دولت و طرح 2011 این نهاد در خصوص مسئولیت سازمانهای بینالمللی، به مسئولیت در ارتباط با
عمل غیر، که از آن به مسئولیتاشتقاقی یاد شده است، توجه داشته و نیز محاکم بینالمللی و در رأس
آنها دیوان بینالمللی دادگستری به اقتضای قضایای مطروح، آن را تأیید کردهاند.
نقش آمریکا در کمک به عراق، طی جنگ علیه ایران، در بهکارگیری سلاحهای شیمیایی،
مجال خوبی برای اعمال مسئولیت اشتقاقی فراهم ساخته است. پرسشاصلی این مقاله آن است که
آیا در پهنه مسئولیت بینالمللی دولت، میتوان آمریکا را از باب کمک و تجهیز عراق در
بهکارگیری تسلیحات شیمیایی علیه ایران، مسئول دانست؟ آگاهی آمریکا از حملات شیمیایی
عراق علیه ایران و تعهد هر دو کشور، بهطور مثال به پروتکل 1925 ژنو موجب میشود تا کمک
آمریکا به عراق، مسئولیتاین کشور را به دنبال داشته باشد.

قاعده حقوق خاص؛ زمینهای برای عملیاتی شدن اصل تخصص سازمانهای بین المللی
اصل تخصص سازمانهای بینالمللی ایجاب میکند که حقوق و تعهدات هر سازمان، تابعی از
حدود اختیاراتی باشد که اعضا به آن واگذار میکنند. این اصل میتواند نقش مؤثری در تعیین
رژیم حقوقی این دسته از تابعان حقوق بینالملل، ازجمله در بحث مسئولیت بینالمللی آنها ایفا
کند. طرح پیشنویس مسئولیت بینالمللی سازمانهای بینالمللی، مصوب 2011 کمیسیون حقوق
بینالملل، به شیوه خاصی اصل مزبور را لحاظ کرده است که متضمن نوعی برخورد میانه با آن
است. کمیسیون، ضمن پذیرفتن اهمیت اصل تخصص در حقوق سازمانهای بینالمللی، از قبول
آن بهعنوان مبنایی بر تمامی مقررات مربوط به مسئولیت سازمانهای بینالمللی، خودداری کرده اما
سعی در عملیاتیکردن آن (Lex Specialis) به طرق دیگر و عمدتاً با اتکا به قاعده حقوق خاص
است در ماده 64 طرح « ترجیح قانون خاص بر قانون عام » کرده است. این قاعده که متضمن مفهوم
مسئولیت سازمانهای بینالمللی پیشبینی شده و زمینهای برای رعایت شرایط حقوقی خاص هر
سازمان بینالمللی در مواجهه با قواعد عام مسئولیت بینالمللی فراهم کرده است.
این نوشتار با هدف تبیین جایگاه اصل تخصص در مقررات مسئولیت بینالمللی سازمانهای
بینالمللی، رویکرد خاص کمیسیون حقوق بینالملل نسبت به این موضوع را ارزیابی کرده است.
