چکیده

قانون تأمین‌کننده نیازهای رو به رشد جامعه است. همگامی قانون با این نیازها مستلزم به‌روز‌رسانی و انطباق با آنهاست. اما این ویژگی نسبت به قانون اساسی به‌راحتی قابلیت اطلاق ندارد؛ زیرا برخلاف قوانین عادی، سازوکار دشوار بازنگری در قانون اساسی، این مسئله را تحت‌الشعاع قرار می‌دهد. از همین رو، با وجود آنکه اصلاح قانون اساسی همچون قوانین دیگر ضروری است، قوانین اساسی‌ای که کمتر منعطف‌اند، کمتر بازنگری به خود دیده‌اند. این امر منجر می‌شود تا روش‌های غیررسمی، برای اصلاح قانون اساسی رواج یابد. شناسایی عرف‌های حقوق اساسی به‌عنوان یکی از این روش‌ها، با تکیه بر عملکرد سیاستمدارن در اصلاح قانون اساسی در قالبی چون حذف بخشی از قواعد متروک و الحاق سازوکار جدید، گامی برای اصلاح و بازنگری در قانون اساسی در شاکله‌ نانوشته است. با این حال، نمی‌توان هر تصمیم سیاسی‌ را به‌عنوان بازنگری غیر رسمی و در قالب عرف درنظر گرفت. هدف از این مقاله، تبیین چهارچوبی برای تغییر غیر رسمی در قانون اساسی به وسیله‌ی عرف است.

چکیده [English]

The law is provider of growing needs of the society. The concordance of law with these needs requires constant updating and adapting to them. But this feature is not easily applicable to the constitution due to the fact that contrary to ordinary law, difficult mechanism of review in the constitution, eclipse this issue. Although reform of the constitution is as necessary as any other law, particularly constitutions that are less flexible, they have undergone less revision. This leads to the spread of informal methods to amend the constitution. Identifying conventions of constitution as one of these methods, relying on the performance of politicians in constitutional reform in forms such as removing part of the antiquated rules and joining a new mechanism, is a step towards reforming and reviewing the constitution in an unwritten form. However, any political decision cannot be considered as an informal review and in the form of convention. The purpose of this article is to state a framework for informal constitutional change by convention
