چکیده

دیوان بین‌المللی دادگستری به عنوان رکن اصلی قضایی ملل متحد نه تنها وظیفة حل و فصل اختلافات میان دولت‌ها را دارد، بلکه وظیفة حفاظت از ارزش‌های مورد قبول اعضای جامعة بین‌المللی را نیز بر عهده دارد. از آنجا که وظیفة دیوان رسیدگی به اختلافات بر اساس قواعد موجود است نه بر اساس قواعد مطلوب، تغییر و تحولات صورت گرفته در عرصة حقوق بشر تأثیر خود را بر عملکرد دیوان داشته است. نمود بارز این تغییر عملکرد را به خوبی می‌توان در قضیة گینه علیه کنگو مشاهده نمود. در این رأی دیوان با تأکید مجدد بر قواعد حقوق بشر به عنوان جزئی از مجموعة قواعد حقوق بین‌الملل، ضمن کمک به انسجام و وحدت حقوق بین‌الملل، زمینة ارتقای احترام و رعایت حقوق بشر را نیز فراهم می‌سازد. از دیگر دستاوردهای مهم در این رأی تغییر قلمرو ماهوی حمایت دیپلماتیک و حکم به پرداخت غرامت برای جبران خسارات غیر مادی است.

چکیده [English]

International court of justice as main judicial organ of United Nations not only has duty to resolve disputes between states but also has duty for protecting values which are accepted by members of international community. However, it has duty to resolve disputes according existing rules not according lex ferenda, changes in the area of human rights affected function of ICJ. We can observe clearly these changes in function of ICJ in the case of Guinea against Congo. In this judgment, ICJ by refocusing on human rights rules as a part of corpus of rules of international rules, through helping solidarity of international law, prepared a field for respect and compliance of human rights.
Another important outcome of this case is changing the material domain of diplomatic protection and verdict to payment of compensation for reparation of nonmaterial damages.
