چکیده

طبق طرح توقف بهره برداری از جنگل که نهایتا در ماده 36 «قانون برنامه هفتم پیشرفت» مندرج شد، بهره برداری چوبی از درختان جنگلی کشور ممنوع می شود و صنایع چوبی باید نیاز خود به چوب خام را از محل درختان آسیب دیده و درختان دست کاشت تأمین کنند. اجرای این طرح از یکسو به حفاظت از جنگل های آسیب پذیر کشور کمک می کند، اما از سوی دیگر سازکار حقوقی و شیوه اجرای این طرح چالش هایی پیش رو دارد که باید شناسایی و حل شوند. این مطالعه با روش توصیفی، تحلیلی و آسیب شناسی حقوقی به بررسی ضرورت تصویب طرح توقف بهره برداری از جنگل و چالش های حقوقی آن می پردازد و نتیجه میگیرد که ابهامات قانونی و نبود مقررات دقیق و راهبردهای بلند مدت برای مدیریت جنگل های کشور موانعی جدی در مسیر موفقیت این سازکار قانونی است. تصویب قانونی جامع و یکپارچه برای ایجاد نظم حقوقی جدید برای حفاظت از جنگل های کشور و تأمین پایدار چوب راهکار قابل تأملی است.

According to the forest logging cease plan which has been enacted in the Article 36 of Act on the seventh Progress Plan, the exploitation of wood from the country's forest trees is prohibited, and the wood industry must meet its need for raw wood from damaged trees and hand-planted trees. On the one hand, the implementation of this plan protects the country's vulnerable forests, but on the other hand, the legal mechanisms and the methods of implementing this plan are challenged with some problems that must be identified and resolved. This study examines the necessity of approving the plan to cease forest exploitation and its legal challenges with descriptive, analytical and legal pathology methods and concludes that legal ambiguities and the lack of detailed regulations and long-term strategies are serious obstacles for the management of the country's forests. A new comprehensive and integrated law is required for building new legal order for the country’s forest management.
