وضعیت حاکمیت در اتحادیه اروپا در پرتو آرای دیوان دادگستری اتحادیه اروپا

چکیده
با تأسیس اتحادیه اروپا مفهوم حاکمیت سنّتی با تحوّلاتی مواجه شد؛ زیرا از یکسو مسئله حاکمیت دولت‌های اروپایی و از سوی دیگر، مسئله حاکمیت اتحادیه اروپا مطرح می‌شود. حاکمیت در شکل نوین با حاکمیت در فضای سنتی متفاوت است. در گذشته حاکمیت مطلق برای دولت­ ها تعریف می­ شد امّا تحولاتی که رخ دادند موجب شدند تا بتوان حاکمیت نسبی را نیز برای موجودیت‌های حقوقی تعریف کرد که این مقاله به منظور تبیین فرسایش مفهوم سنتی حاکمیت به دلیل تحول حقوق بین‌الملل به سمت فردمحوری ارائه شده است. در خصوص حاکمیت در اتحادیه اروپا سه رویکرد وجود دارد: یک رویکرد حاکمیت دولت­ ها را بر حاکمیت اتحادیه اروپا برتری می­ دهد و رویکرد دیگر، حاکمیت اتحادیه اروپا را نسبت به حاکمیت دولت­ های اروپایی ارجحیت می ­بخشد. رویکرد سوم پیشی­گرفتن راه‌حلّی میانه است؛ به گونه­ ای که هیچ یک از این دو را بر دیگری برتری نمی ­بخشد؛ بلکه برای هر یک قلمرو خاصّی را مشخّص نموده است. طبق این رویکرد، قلمرو اتحادیه اروپا و کشورهای عضو به عنوان دو قلمرو جداگانه تعریف می‌شوند که با یکدیگر تعارضی نمی ­یابند؛ بلکه وظایف آن­ها در راستای منافع یکدیگر پیش می­رود و علت وجودی تشکیل اتحادیه از ابتدا نیز آن بوده که منافع مشترک دولت­ های اروپایی به نحو بهتری تأمین گردد.

چکیده English

With the establishment of the European Union, the concept of traditional sovereignty underwent changes; Because on the one hand there is the issue of the sovereignty of European governments and on the other hand there is the issue of the sovereignty of the European Union. In the past, absolute sovereignty was defined for governments; But the developments that took place made it possible to define relative sovereignty for legal entities. There are three approaches to governance in the EU. One approach favors the sovereignty of states over the sovereignty of the Union, and the other approaches the sovereignty of the Union over the sovereignty of European states. The third approach is to take the middle ground that neither of the two is superior to the other; in which that the territory of the Union and the member states are defined as two separate territories that do not conflict with each other. In fact, there is no conflict between the tasks of the Union and the member states; Rather, their tasks are in the interests of each other, and the reason for the formation of the Union from the beginning has been to better serve the common interests of European governments.
